Kody Kaplon is charged with attempted murder, sexual intercourse with a victim under 10 years of age, sexual penetration with a foreign object with a victim under 10 years of age, two counts of sexual oral copulation with a victim under 10 years of age, kidnapping and endangering the health of a child. Evidence of personal infliction of great bodily injury upon a child under 5 years of age is considered as a special allegation, making all seven counts violent and serious felonies under California’s three strikes law.

MO v Collings, Christopher

Trial Date: April 2011 – Death Penalty Case ((Sara Forhetz, Judge Delays Trial of Chris Collings for Rowan Ford’s Murder in Barry County, MO, KY3.com, 12.01.10.))
Victim: Rowan Ford, 9 years
Christopher Collings, a friend of Rowan Ford’s stepfather, David Spears is charged with first-degree murder, rape and kidnapping. David Spears is also charged with first-degree murder and rape.

VT v Jacques, Michael

Trial Date: September 2011
Michale Jacques, a previously convicted sex offender, is charged with sexual assault and murder of his niece, Brooke Bennett, 12 years. Vermont does not utilize the death penalty; however, prosecutors sought federal prosecution which would allow for the death penalty. The request was granted. Jacque’s attorneys are vigorously fighting the federal charge which, if won, would save their client from the death penalty.

Mark Edward Mesiti is charged with the molestation and murder of his daughter, Alycia Mesiti, 14 years. It is alleged that after he murdered Alycia, he buried her body in the backyard of their home. He then reported her as a runaway. It is unknown at this time if prosecutors will seek the death penalty.

Anthony Theard is charged with the murder of his daughter, Camille Ferguson, 5 months. It is unknown at this time if prosecutors will seek the death penalty.

Richard McTear is charged with the murder of his ex-girlfriend’s son, Emanuel Wesley Murray, 3 months. Prosecutors will seek the death penalty in this case.
GA v Edenfield, George
Deemed unfit to stand trial until further notice. Sent to state mental hospital.
George Edenfield is charged with the sexual assault and murder of his neighbor, Christopher Barrios, 6 years. Edenfield’s mother is also charged with the murder. David Edenfield, George’s father, was already tried and convicted of his part in Christopher’s murder. David Edenfield was sentenced to death. If it is determined that George Edenfield does not suffer from some sort of mental defect, he will also face the death penalty.
GA v Edenfield, Peggy

Peggy Edenfield is charged with the murder of her neighbor, Christopher Barrios, 6 years. She accepted a plea deal to remove the death penalty. As a part of the plea arrangement she agreed to testify against her husband and so who were also charged with Christopher’s murder. She testified against her husband, David Edenfield, in his trial. He was found guilty and was sentenced to death. Prosecutors are waiting to find out if George Edenfield is fit to stand trial. After Peggy testifies against her son, George, she will stand trial.

William Balfour is charged with the murder of his stepson, Julian King, 7 years. He is also charged with murdering two other family members. It is unknown at this time if prosecutors will seek the death penalty.
MI v Thomas, Lorrie
Trial Date: Pending
Lorrie Thomas is charged with the starvation death of her adopted daughter, Shylae Thomas, 9 years. Shylae suffered from brain damage and required constant care. Thomas is accused of allowing Shylae to starve to death and then placing her body in a plastic storage container, which she then placed in a storage facility. Prosecutors will not seek the death penalty because Michigan does not impose the death penalty.

Dawn Yorke is charged with the murder of her granddaughter, Linda Steele, 4 years. There is a possibility that Yorke murdered her granddaughter because she was experiencing a psychotic break.
NC v Heuser, Johni Michelle
Trial Date: Pending
Johni Heuser is charged with the murder of her daughter, Harmony Jade Creech, 11 months. Prosecutors are seeking the death penalty in this case.
NC v Hunter, Marquell

Marquell Hunter is charged with the murder of Rashed Delamez Jones, 14 years. Rashed was a possible witness to a shooting that would have incriminated the accused. It is unknown at this time if prosecutors will seek the death penalty. Also charged in this murder is Santonio Jenrette, Rashed’s cousin.

Santonio Jenrette is charged with the murder of his cousin, Rashed Delamez Jones, 14 years. Rashed was a possible witness to a shooting that would have incriminated the accused. Jeremiah Craft is charged with the murder of Bridget Herard, 16 years. Craft was the boyfriend of a long-time family friend of the Herard’s. Craft lured Bridget to his home under the ruse of a babysitting job. It is unknown at this time if prosecutors will seek the death penalty.

Melissa Wright is charged with the torture child abuse murder of her son, Alexander G. Wright, 3 years. Also charged with this murder is Wright’s boyfriend at the time, Randy Carter. It is unknown at this time if prosecutors will seek the death penalty.

    The legal process has be gun for Mark Mesiti. Arraignment is continued until 6/13/2011. 45 amended charges have been filed. A SUBTERRANEAN, SUBHUMAN MONSTER, AIDED AND ABETTED BY A HOSTILE AND INEXCUSABLE FAMILY COURT SYSTEM. The DA HAS NOT YET DECIDED IF SHE WILL SEEK THE DEATH PENALTY.

      @anonymous: I made the changes you requested and deleted the other comments requesting the changes. I recently read about the charges being filed against Mesiti. I hope the DA does seek the death penalty. Unfortunately, even if Mark is found guilty and sentenced to death, he would most likely die in prison from natural causes, murder, or suicide. The average length of time between conviction and execution is about 30 years.
      Most likely the DA will not seek the death penalty if she follows the current trend in California that leans towards abolishing the death penalty.

      My opinion is that the people of California should be able to vote on whether we abolish the DP or not.

    I believe Anthony Demone Theard has been released from prison, and only served a very small time for killing his 5 month old daughter. Could you confirm this, I don’t think this monster should be running around loose ont the streets. He had been covicted of Pimping before the alleged murder of his daughter took place, and just seems in general to have a hatred towards females in general.

      Monica, I checked around today and I couldn’t find any reference to Anthony Theard having had a trial let alone being sentenced to prison. The most recent information was in 2006 when he entered a plea of not guilty at the preliminary hearing. I tried court records and there is a file there for him but it is not viewable by the public.
